Coverage:

For automobile accidents in California, the minimum liability insurance limit is $15,000 per person & $30,000 per occurrence for bodily injury and $5,000 for property damage. This means that the most an insurance company can pay any one person is $15,000 and a total of $30,000 if there is more than one injured person. It also mean the most an insurance company can pay for all property damage $5,000.

Uninsured Motorist Coverage:

If you carry full coverage with your own automobile insurance carrier, you will have uninsured and underinsured motorist coverage. Uninsured Motorist Coverage provides coverage if the other party involved in the accident is uninsured or a “hit & run” vehicle. Underinsured motorist coverage provides additional money if the liability limits for the driver of the other vehicle are insufficient to compensate you for your injuries, medical expenses and losses.

It is highly recommended that you purchase this coverage in your insurance policy. This is especially useful in “hit & run” accidents when the person who injures you flees the scene without exchanging information and you have no identified person to sue. Though it is illegal for anyone to flee the scene of accident, it is very common, and you can still be compensated for your losses if you have Uninsured Motorist Coverage. As a matter of fact, it is illegal for an insurance agent to sell automobile insurance without offering you Uninsured Motorist Coverage unless a written waiver is obtained.

Medical Payment Coverage:

If you carry full coverage, you will have a provision for medical payments coverage. This coverage pays for your medical expenses up to your policy limits and for medical expenses incurred as a result of your car accident. This provision also applies if you were at fault for the accident or a passenger in the vehicle. If you do not carry full coverage or medical payment coverage, you can request that your health insurance cover your medical expenses. The last thing you want, after having to deal with all of the pain, and suffering, and other inconveniences associated with the accident, is having medical providers contacting you requesting payment on a bill. It is important to provide your insurance coverage information to your lawyer when assessing your claim.

CALIFORNIA STATUTE OF LIMITATIONS

In general, all automobile accident cases have a statute of limitations. In a car accident involving a non-governmental entity, you have 2 years from the date of the accident to either have your case settled or have a lawsuit on file with the court. If the accident involves a political subdivision, such as a county, city or the State, you generally have only six months to file a Governmental Tort Claim. If you do not comply with the statute of limitations, you will forever lose your rights to make a claim for your injuries and damages. However, you have three years to make a property damage only claim before you need to file a lawsuit.
